Terms of Service

1. The service

Breaknorm provides access to a database of company profiles built from publicly available company websites, together with decision-maker contact information and email finding and verification. The service is delivered through an MCP server, a REST API and a web application at app.breaknorm.co. Features, data coverage and limits per plan are described on breaknorm.co/#pricing and may change over time.

2. Accounts and API keys

• You must provide accurate account information and keep your password and API keys confidential. Anything done with your keys is treated as done by you.
• One account per person or company. You may create several API keys under one account.
• You must be at least 18 and use the service for business purposes only.

3. Acceptable use

You agree not to:

• resell, sublicense or redistribute the data as a standalone dataset, or use it to build a competing database;
• send unsolicited communications that violate applicable law (including CAN-SPAM, GDPR, PECR and equivalent rules) or the policies of the email or messaging provider you use;
• scrape, bulk-export or circumvent plan limits, rate limits or access controls;
• use the data to discriminate against, harass or harm any person, or for any unlawful purpose.

We may suspend or terminate accounts that breach this section. You are responsible for complying with the laws that apply to your outreach in the countries you target.

4. Plans and billing

• New accounts start on the Free plan: 1,000 records in total, with no time limit and no payment method required. Free records do not refill. Accounts that started on an earlier free trial keep it until its end date and then move to the Free plan.
• Each paid plan includes one record allowance, shown on the pricing page and in the app, that refills on a rolling 5-hour window and a weekly window. When the allowance is used up, requests pause until it frees up; we never bill overage.
• Plans that are no longer offered remain available, at their price and limits, to subscribers already on them for as long as that subscription stays active without interruption.
• Paid plans are billed monthly in advance, in US dollars, through Stripe. Prices are shown on the pricing page and in the app before you subscribe.
• Plans renew automatically each month until cancelled. You can upgrade or downgrade at any time; changes are prorated.
• If a renewal payment fails, we retry it for up to 7 days. During this period access continues with reduced limits; afterwards access is suspended until the invoice is paid.
• Taxes may be added where required by law.

5. Cancellation and refunds

You can cancel at any time from Billing in the app. Cancellation takes effect at the end of the current billing period and you keep access until then. Our full refund, cancellation and dispute policy is at breaknorm.co/refunds and forms part of these terms.

6. Promotions

Discount codes, founding prices and other promotions are valid only for the period and plans stated when offered, cannot be combined unless we say otherwise, have no cash value, and may be withdrawn for new customers at any time. A price locked for an existing subscription stays locked for as long as that subscription remains active without interruption.

7. Data and privacy

How we handle your account data, and how we process data about business contacts in the database, is described in our Privacy Policy at breaknorm.co/privacy. Where you act as a controller of the data you pull from Breaknorm, you are responsible for your own compliance.

8. Intellectual property

The service, software, database structure and documentation are owned by BreakVentures LLC. You receive a limited, non-exclusive, non-transferable licence to use the service and the data you retrieve for your own internal sales and marketing purposes, for as long as your subscription is active.

9. Availability and warranty

We aim for high availability but do not guarantee uninterrupted service. The data is compiled from public sources and verified where stated; it is provided “as is”, without warranty of completeness, accuracy or fitness for a particular purpose. Email verification results reflect the state of a mailbox at the moment of the check.

10. Limitation of liability

To the extent permitted by law, BreakVentures LLC is not liable for indirect, incidental or consequential damages, or for lost profits or revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

11. Export and legal restrictions

You may not use the service if you are located in, or ordinarily resident in, a country subject to comprehensive US sanctions, or if you are on a US, EU or UK sanctions list. You agree to comply with applicable export control laws.

12. Changes and termination

We may update these terms; material changes are announced by email or in the app at least 14 days before they take effect. Continued use after that date means acceptance. Either party may terminate at any time; sections 3, 8, 9, 10 and 13 survive termination.

13. Governing law and contact
